1. Introduction

Welcome to Pearl Wellness & Detox, a holistic health med spa committed to your well-being through detoxification, colon cleansing, water therapies, hormonal health support, naturopathic services, homeopathic services, and holistic nutritional counseling. By accessing and using our website or services—including communication via Short Message Service (SMS)—you agree to be bound by these Terms and Conditions (hereinafter referred to as “Agreement”).

 

2. Services Provided

Our services include but are not limited to:

  • Personalized detoxification programs
     

  • Colon cleansing treatments
     

  • Hydrotherapy and water-based therapies
     

  • Hormonal health consultations and support
     

  • Nutritional assessments and counseling
     

  • Educational and lifestyle wellness programs
     

3. Client Understanding

By using our services, you acknowledge and agree that:

  • You understand the benefits, risks, and intended purposes of our treatments
     

  • You have disclosed (and will continue to disclose) your complete medical history, including medications, conditions, and allergies
     

  • You accept responsibility for the outcomes related to your adherence to recommendations
     

4. Informed Consent

You voluntarily consent to receive treatments from Pearl Wellness & Detox and affirm that you have been informed of the following:

  • Potential benefits, risks, and side effects
     

  • Alternative treatment options, if applicable
     

  • The need to follow through on care plans and post-treatment guidance
     

5. Communication Consent (Including SMS)

By consenting to receive communication from us, you agree to:

  • Receive transactional, informational, and promotional messages via SMS and other communication channels
     

  • Message frequency will be kept reasonable and relevant to your services
     

  • You may opt out anytime by replying “STOP” to any SMS or following instructions provided within messages
    Standard carrier rates may apply; we are not liable for these charges.
     

6. Payment and Cancellation Policies

We operate under transparent financial policies, including:

  • Payment Terms: Full payment is due at the time of service unless otherwise arranged. We accept major credit cards, debit cards, and digital payment platforms.
     

  • Cancellations: Please cancel or reschedule at least 24 hours in advance to avoid a late cancellation fee. The late cancellation fee is 50 % of the value of the session missed. Once we schedule you, we forfeit the opportunity to offer that session slot to a different client. Please do everything you can to inform us if you cannot make your appointment on time.  
     

  • Refund Policy: Refunds for prepaid packages or services will be assessed case-by-case. Services rendered are non-refundable.
     

7. HIPAA and Privacy Compliance

We are committed to maintaining the confidentiality of your protected health information (PHI) in compliance with the Health Insurance Portability and Accountability Act (HIPAA). For more details, please review our full Privacy Policy [available upon request].

 

8. Data Usage and Privacy

We collect and use your data in accordance with our Privacy Policy. This includes:

  • Storage and usage of contact and health information for communication and care
     

  • Data security protocols to protect your personal information

10. Service Availability and Limitations

While we strive for continuous access to all services and communications, we cannot guarantee uninterrupted operation due to external factors (e.g., power outages, network issues, or public emergencies). In such events, we’ll do our best to notify affected clients and reschedule as needed.

 

11. Client Responsibilities

To support safe and effective care, clients agree to:

  • Provide accurate and current health information
     

  • Communicate any new or changing symptoms or medication use
     

  • Follow treatment plans, lifestyle recommendations, and pre/post-care instructions
     

12. Limitation of Liability

Pearl Wellness & Detox is not liable for:

  • Adverse reactions due to undisclosed health conditions
     

  • Complications arising from the combination of our treatments with other therapies or medications
     

  • Client noncompliance with recommendations or instructions
     

13. Disclaimer of Guarantees

While we are committed to high standards of care, we cannot guarantee specific health outcomes. Results vary based on individual biology, lifestyle, and adherence to protocols.

 

14. Intellectual Property

All materials on our website—including proprietary treatment protocols, content, graphics, and educational materials—are protected by intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

 

15. Governing Law

This Agreement is governed by the laws of the State of New York, without regard to conflict of law principles.

 

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Pearl Wellness & Detox concerning our services and website use. No other agreement, statement, or promise made on or before the effective date of this Agreement will be binding.
